LEGAL NOTICE OF PUBLIC HEARINGS
PURSUANT TO ORC §1521.18
AMENDMENT TO FULTON COUNTY FLOOD PLAIN REGULATIONS
The Fulton County Board of Commissioners will hold two (2) public hearings on revision to the Fulton County Flood Damage Prevention Regulation Resolutions adopted by said Board on January 27, 2011, effective thirty-one (31) days thereafter on February 28, 2011, as required by the Ohio State Department of Natural Resources, Division of Soil and Water.
Said Amendment calls for the amendment of county language for the Violations and Enforcement Section 6.3 of the model regulations to include reference to ORC 307.99(C) as follows:
Violation of the provision of thee regulation, or failure to comply with any of its requirement or lawful orders issued pursuant thereto, shall be deemed to be a strict liability offense. Any person who violated these regulations, or fails to comply with any of its requirement or lawful orders issued pursuant thereto, shall, upon conviction thereof, be fined not more the $300.00 and, in addition, shall pay all costs and expense involved in the case as provided by the laws of Fulton County. Each day such violation continues shall be considered a separate offense. Nothing herein contained shall prevent Fulton County from taking such other lawful action as is necessary to prevent or remedy any violation. Fulton County shall prosecute any violation of these regulations in accordance with the penalties stated herein.
Public Hearings will be held at follows in the Fulton County Commissioners’ Chambers, 152 S. Fulton St., Suite 270, Wauseon, OH 43567:
1st hearing – March 8, 2012 at 11:00 a.m.
2nd hearing – March 12, 2012 at 10:00 a.m.
The purpose of the public hearing is to provide citizens with pertinent information about the amendment and requirements thereunder. Citizens are encouraged to attend either of these meetings to provide input. If a participant will need auxiliary aids (interpreter, Braille or taped material, listening device, or other) due to a disability, please contact the Fulton County Commissioners prior to the hearing dates at 419-337-9255 in order to insure that your needs will be accommodated. The facility is handicap accessible.
