[ARCHIVED] Notice of Continuance of Final Hearing on Ditch Improvement Petition 2108-Storeholder


In the matter of Single County Ditch Petition No. 2108, as Petitioned for by Lawrence Storeholder, et. al.

WHEREAS, on September 11, 2014, being fixed by the Fulton County Board of Commissioners in its Order dated July 21, 2014, the Board of Commissioners held the final hearing on the report, plans, schedules, assessments and claims for compensation of damages as filed by the County Engineer and any application for a change in route or change in nature, kind, and/or extent of work proposed therein; and

WHEREAS, upon hearing testimony and considering all evidence as presented by the landowners and the Chief Deputy Engineer at said hearing, the Board of Commissioners instructed the County Engineer to create an alternate set of plans, and assessments in accordance therewith; and

WHEREAS, the Fulton County Board of Commissioners voted unanimously to stay final decision and so ORDERED a continuance of the Final Hearing until such time the alternate plans and assessments were completed and presented to the Board and the affected landowners for further consideration thereof.

THEREFORE, YOU ARE HEREBY NOTIFIED that the Fulton County Board of Commissioners shall hold the continued FINAL HEARING on Ditch Petition 2108, filed by Lawrence Storeholder, et al. on October 9, 2014 at 10:30 a.m. in their Chambers located at 152 S. Fulton Street, Suite 270, Wauseon, Ohio 43567; and

YOU ARE FURTHER NOTIFIED that all claims for compensation or damages must be filed with the Clerk of Commissioners before that date; and

YOU ARE FURTHER NOTIFIED that should the Commissioners find for the improvement, you must give written notice on the enclosed form, within 21 days of the final hearing, or October 31, 2014, whichever is later, of your intention to pay your assessment in cash in lieu of the assessment being placed on your tax duplicate, and without interest thereon
